| Summary: | Este trabalho de conclusão de curso tem por objetivo expor o Direito de Laje como direito real positivado através da Medida Provisória 759 de dezembro de 2016, convertida na Lei 13.465 de 11 de julho de 2017. Trata-se de um fato social descuidado pelo legislador, que se omitiu em relação à situação de milhares de brasileiros, deixando esta população, majoritariamente carente, às margens da sociedade. Destarte, as camadas populacionais excluídas passam a criar, paralelamente ao Estado, normas a serem aplicadas dentro de seu contexto social. Pretende-se investigar, para além da regulamentação legislativa, como esse novo instituto jurídico surtiu efeitos na sociedade brasileira. |
| Abstract: | This study aims to expose the Right of Slab as a real right recently positived through Provisional Measure 759 of December 2016, converted into Law 13,465 of July 11, 2017. It is a social fact neglected by the legislator, which was omitted in relation to the situation of thousands of Brazilians, leaving this population, mostly in need, on the margins of society. Thus, the excluded population starts to create, parallel to the State, norms to be applied within their social context. It is intended to investigate, in addition to legislative regulation, how the application of this new legal institute had effects on Brazilian society. |
