| Summary: | O objetivo do presente trabalho é analisar a inovação jurídica trazida com o julgamento do Recurso Especial n.º 1.474.665/RS, em sede de recurso repetitivo, o qual consolidou a possibilidade de fixação de multa coercitiva contra o Estado para coagi-lo a fornecer medicamento a pessoa desprovida de recursos financeiros. O reconhecimento do direito à saúde como direito fundamental social, com o advento da Constituição Federal de 1988, é resultado de sua vinculação com o princípio da dignidade da pessoa humana e com o direito à vida, sendo atribuído aos entes públicos o dever de proteção e de execução desse direito. Por meio da análise dos entendimentos doutrinários e jurisprudenciais, bem como da legislação, busca-se destacar como a imposição de multa diária aos entes públicos pode resultar em um meio para garantir a efetivação do direito à saúde, conforme estabelece o art. 196 da Carta Magna. |
| Abstract: | The goal of this paper is to analyze the legal innovation brought with the judgment of the Special Appeal nº. 1.474.665 / RS, in a repetitive appeal, which consolidated the possibility of setting a coercive fine against the State to force it to provide medicineto a person without financial resources. The recognition of the right to health as a fundamental social right, with the advent of the Federal Constitution of 1988, is the result of its connection with the principle of human dignity and the right to life,being assigned to the public entitied the duty to protect and execute that right. Through the analysis of doctrinal and jurisprudential understandings, as well as legislation, we seek to highlight how the imposition of daily fines to public entities can result in a way to ensure the realization of the right to health, as established by art. 196 of the Magna Carta. |
