| Summary: | O presente artigo analisa o princípio da liberdade sindical no Brasil após a promulgação da Lei 13.467/17 e tem como objetivo apontar os possíveis caminhos para a vigência da liberdade sindical plena, por meio da Convenção n° 87 da OIT no ordenamento jurídico brasileiro. Para tanto, perpassa pelos aspectos históricos do sindicalismo no Brasil, bem como examina a Convenção nº 87 da OIT não ratificada pelo Brasil. Em seguida o texto apresenta uma verificação da liberdade sindical como direito humano e direito fundamental, bem como discute em tópico subsequente acerca das alterações introduzidas pela Reforma Trabalhista. Por fim, verifica que a liberdade sindical plena é indispensável para a manutenção de um Estado Democrático de Direito. O método investigativo de abordagem utilizado foi o dedutivo, visto que analisa a relação entre as premissas e a conclusão. |
| Abstract: | This article analyzes the principle of freedom of association in Brazil after the prommulgation of Law 13.467/17 and aims to identify the possible paths to full freedom of association, through Convention n°87 of the ILO in the Brazilian legal system. To do so, ir covers the historical aspects of trade unionism in Brazil, as well as examining ILO Convention n° 87 not ratified by Brazil. The next then presents a verification of the freedom of association as a human right and fundamental right, as well as discusses in a subsequent topic about the changes introduced by the Labor Reform, finally it verifies that full freedom of association is indispensable for the maintenance of a Democratic State of Right.
