Summary:	A presente dissertação discorre sobre a problemática da fundamentalidade do direito ao lazer na relação empregatícia, especialmente em relação a duração do trabalho, as novas regulamentações contratuais e os novos parâmetros da responsabilidade civil extrapatrimonial a fim de demonstrar que a reforma trabalhista relativizou inconstitucionalmente o mencionado direito. Para cumprir com esse objetivo o presente trabalho aborda os direitos fundamentais e sua correlação com o Direito do Trabalho e a Teoria Geral dos Contratos utilizando como marco teórico a eficácia dos direitos fundamentais nas relações privadas (Drittwirkung), o método de abordagem complexo e dialético, o método de procedimento comparativo e a técnica de pesquisa de documentação indireta.
Abstract:	This dissertation discusses the fundamental issue of the right to leisure in the employment relationship, especially in relation to working time, new contractual regulations and the new parameters of off-balance civil liability in order to demonstrate that labor reform has unconstitutionally relativized said right. To fulfill this objective, the present work deals with fundamental rights and their correlation with Labor Law and the General Theory of Contracts, using as a theoretical framework the effectiveness of fundamental rights in private relations (Drittwirkung), the method of complex and dialectical approach, the comparative procedure method and the indirect documentation research technique.
