| Summary: | O presente trabalho se propõe a analisar a aplicabilidade do instituto da Responsabilidade Civil no Direito das Famílias, notadamente no que concerne à possibilidade de indenização por dano decorrente da perda de uma chance no âmbito familiar. Inicialmente é traçado um panorama geral do encontro entre a Responsabilidade Civil e o Direito das Famílias, apontando seus contornos contemporâneos e a ideia de dano moral na seara familiarista. Após, passa-se à análise da teoria da perda de uma chance e suas peculiaridades. Por fim, estuda-se a recepção da teoria pelo direito brasileiro e, mais especificamente, pelo Direito das Famílias, apontandose algumas hipóteses de aplicação da tese e as problemáticas envolvidas. |
| Abstract: | The following term paper aims to analyze the applicability of Civil Liability within the Family Law, especially regarding to the possibility of compensation for damages caused by the loss of chance in a family background. Initially, it is written an overview on the connection point between Civil Liability and Law Family, pointing its modern contours and the idea of moral damages on the family field. Then, it is analyzed the loss of chance doctrine and its peculiarities. At the end, it is studied how the theory is adopted by the Brazilian legal system e, more specifically, by Family Law, by pointing some hypothesis in which the loss of chance doctrine may be applied and the issues involved. |
