| Summary: | O presente trabalho tem por escopo a reflexão sobre a possibilidade de responsabilizar penalmente a pessoa jurídica pela prática de crimes ambientais. Para enfrentar o tema discorreu-se preliminarmente acerca da importância do meio ambiente atrelado à sua proteção jurídica e, consequentemente, constitucional, levando em consideração o surgimento da consciência ecológica e da sustentabilidade na sociedade contemporânea. Não obstante, foi abordado de forma sintetizada os princípios informadores do Direito Ambiental, bem como a normatização penal do meio ambiente, diante do reconhecimento deste como bem jurídico-penal protegido. O eixo central do estudo gira em torno da admissibilidade da imputação de sanções penais às pessoas jurídicas por crimes ambientais, analisando a legislação penal nacional, qual seja a Lei de crimes ambientais, a Constituição Federal de 1998 e, por fim, a jurisprudência do Superior Tribunal de Justiça e o Superior Tribunal Federal. |
| Abstract: | This paper has as scope the reflection on the possibility of criminally responsible legal person for the practice of environmental crimes. In order to address the issue, it was preliminarily discussed the importance of the environment linked to its legal and, consequently, constitutional protection, taking into account the emergence of ecological awareness and sustainability in contemporary society. Nonetheless, the reporting principles of Environmental Law were summarized, as well as the criminal law of the environment, recognizing it as a protected legal right. The main focus of the study is on the admissibility of criminal sanctions against legal person for environmental crimes, analyzing national criminal legislation, such as the Environmental Crimes Law, the Federal Constitution of 1998 and, finally, the jurisprudence of the Superior Court of Justice and the Superior Federal Court. |
