Análise dos processos envolvendo cirurgiões-dentistas no Tribunal de Justiça de Minas Gerais

Abstract

Nowadays, every citizen stays connected to the virtual world. This provides greater awareness of their rights as it relates to the increasing number of lawsuits. The present database review seeks to analyze the processes involving Dental Surgeons in the states of Minas Gerais in the period between 1999 and 2017. Data were collected on the website of the Court of Justice of the State of Minas Gerais, data were analyzed and the results evidenced an increase in the number of processes involving dentists and their specialties, it was also possible to observe the location of higher incidence of the processes, their nature of origin and result. The context of each process and participation of technical expertise were recorded. We found 380 processes involving the CD. The specialty most affected was orthodontics, and the nature of the most common process was civil responsibility. It is concluded that there are a large number of processes involving the CD and that many times the professional behavior contributes to the demand. To avoid processes, the CD should maintain up-to-date knowledge, a good relationship, medical records, contracts and appropriate terms of consent. After analyzing the data was proposed through the literature review measures to avoid similar legal demands involving dental surgeons in the state of Minas Gerais, in addition to evidence the importance of the technical expertise performed by a qualified professional in the area of dentistry and the importance of the participation of the assistant dental technician in the procedural process and in the result of the final sentence.
