Summary:	A partir da constatação das dificuldades vivenciadas pelas famílias em acompanhar a educação escolar de seus filhos, sobretudo devido ao compromisso que os pais possuem em suas atividades laborais, além do interesse e todo esmero do autor com o axioma da educação, o presente trabalho possui como objeto de estudo a tutela desse direito. Para tanto, almejou-se levantar e analisar o que o Poder Público tem produzido de norma jurídica a fim de proteger e garantir o direito à educação, em que pese considerar também os direitos e obrigações do próprio Estado, da sociedade civil e da família. Assim, ao passo em que se investiga o tema na legislação produzida a nível federal, bem como nas jurisprudências e nas doutrinas, a problemática da pesquisa é evidenciada especialmente na esfera do trabalho, uma vez verificada a falta de projeção do direito à educação diante do plano legal do trabalho.
Abstract:	Based on the experience of the difficulties experienced by families in accompanying their children's school education, mainly due to the commitment that parents have in their work activities, besides the interest and all the author's dedication to the axiom of education, the present work has as subject of study to protect this right. In order to do so, it was hoped to raise and analyze what the Public Power has produced as a rule of law in order to protect and guarantee the right to education, while also considering the rights and obligations of the State itself, civil society and the family. Thus, while the subject is investigated in federal legislation, as well as in jurisprudence and doctrines, the research problem is evidenced especially in the sphere of work, once verified the lack of projection of the right to education against the legal work plan.
