Summary:	O presente trabalho teve o intuito de analisar a distribuição dinâmica do ônus da prova adotada pelo Novo Código de Processo Civil. Este estudo utilizou-se de pesquisa bibliográfica e pesquisa indireta, realizada por meio de doutrina e jurisprudência. Inicialmente refletindo acerca dos princípios processuais constitucionais e as razões que levaram o legislador a adotar essa teoria, analisando suas peculiaridades. Após estas análises, foi realizado um estudo de forma a ilustrar que a distribuição dinâmica do ônus da prova é mais adequada que a distribuição estática às complexidades dos casos concretos. Ao final, foram apresentados os requisitos exigidos pela nova legislação a aplicação da redistribuição do ônus da prova, como o julgador deve se orientar para decidir sobre essa técnica diante do caso concreto e como a jurisprudência encara o tema.
Abstract:	The present work had the purpose of analyzing the dynamic distribution of the burden of proof adopted by the New Code of Civil Procedure. This study used bibliographic research and indirect research, carried out through doctrine and jurisprudence. Initially, studying the constitutional procedural principles and the reasons that led the legislator to adopt this theory, analyzing its peculiarities. After these analyzes, a study was carried out in order to illustrate that the dynamic distribution of the burden of proof is more adequate than the static distribution to the complexities of the concrete cases. In the end, it was presented the requirements required by the new legislation to apply the redistribution of the burden of proof, as the judge should be guided to decide on this technique in the concrete case and how the case law faces the issue.
