dc.description.abstract	This work will follow the theme of the changes made to the judicial separation and divorce institutes with the advent of the new CPC. From this, the objective here is to shed light on the aforementioned institutes before this new Codex, seeking to bring and understand the changes in the law of the spouses to the separation and divorce within the judiciary. In this way, this research will be sent to a conceptual attempt of the mentioned institutes and, also, to bring the procedural legislative evolutions related to the dissolution of the conjugal society and bond, in order to be able to understand the changes and innovations that have affected the new civil procedural statute. Then, the institute of separation in Family Law will be faced, mainly in the procedural sphere, beginning with the entry of Constitutional Amendment No. 66 of 2010 in the Brazilian legal system and its impacts in the institutes treated here, and then to analyze, from a The legislative insistence on the maintenance of the right of separation. Finally, the special procedure of Family Actions will be discussed in the new CPC, with a total focus on the process of separation and divorce of the spouses.	pt_BR

dc.description.resumo	Este trabalho seguirá a temática das mudanças acometidas aos institutos da Separação e Divórcio judiciais com o advento do novo CPC. A partir disso, o objetivo desta pesquisa é lançar luzes sobre os mencionados institutos frente a esse novo Codex, procurando trazer e compreender as mudanças no direito dos cônjuges à separação e divórcio no âmbito do judiciário. Desse modo, esta pesquisa será remetida a uma tentativa conceitual dos mencionados institutos e, também, trazer as evoluções legislativas processuais relacionadas à dissolução da sociedade e vinculo conjugais, para, então, poder compreender as mudanças e inovações que acometeram o novo estatuto processual civil. Em seguida, será enfrentada a subsistência do instituto da separação no Direito das Famílias, principalmente no âmbito processual, iniciando pelo ingresso da Emenda Constitucional n° 66 de 2010 no ordenamento jurídico brasileiro e seus impactos nos institutos aqui tratados, para depois analisar, de uma forma crítica, a insistência legislativa a respeito da manutenção do direito de separação. Por fim, será abordado o inaugurado procedimento especial das Ações de Família no novo CPC, com total enfoque ao processo de separação e divórcio dos cônjuges.	pt_BR
