Resumo
A presente monografia tratará sobre a necessidade de se deixar de tratar a adoção internacional, uma vez corolário do direito fundamental à família, como uma alternativa secundária e excepcional. Por meio dos métodos dedutivo e dialético, buscar-se-á analisar o aludido expediente e estabelecer um diálogo entre os direitos fundamentais à família e ao crescimento e desenvolvimento regular da criança e do adolescente, contrapondo-os ao entendimento vigente acerca da excepcionalidade da ora mencionada modalidade do instituto da adoção. Ao fim, concluir-se-á pela impropriedade do caráter excepcional da adoção internacional, fazendo-se mister portanto sua alçada ao mesmo status que a adoção nacional.
Abstract
This monograph will deal with the need to stop treating international adoption, once a corollary
of the fundamental right to the family, as a secondary and exceptional alternative. Through the
deductive and dialectical methods, the aforementioned expedient will be analyzed and a
dialogue will be established between the fundamental rights to the family and the regular
growth and development of the child and the adolescent, contrasting them with the current
understanding about the exceptionality of the now mentioned modality of the institute of
adoption. In the end, it will be concluded that the exceptional character of international
adoption is improper, and that its status as a national adoption must therefore be considered.
