Resumo
A presente pesquisa tem como tema a estratégia político-criminal proposta pela teoria da criminologia radical (ou crítica), como resposta ao atual sistema de controle social, que se erige na ideologia da defesa social (ou do controle social). O problema de pesquisa concentra- se na contradição existente entre o aparente fracasso do sistema penal e a sua permanência ao longo da história. A respectiva hipótese se consubstancia no fato de que o referido sistema de controle social, legitimado pelo ideal de defesa social, possui verdadeiro êxito político- econômico, diante de suas reais funções e objetivos (ocultos). O objetivo geral do presente trabalho é apresentar uma estratégia político-criminal ao sistema de controle social, considerando que é injusto, seletivo e desigual. Constituem objetivos específicos do presente trabalho a abordagem da ideologia da defesa social (ou do controle social) e das diversas teorias criminológicas até que fosse desenvolvida a teoria criminológica radical (ou crítica). A criminologia radical propõe estratégias imediatas que culminam na mediata superação do sistema político-econômico capitalista. Pois, considerando a relação histórica entre sistema penal de controle social e estrutura social, apenas se poderá repensar radicalmente aquele se houver a modificação deste. O método de abordagem utilizado é o dedutivo. Quanto aos métodos de procedimento, consubstanciam-se no comparativo e no funcionalista. Por fim, a técnica de pesquisa utilizada é a bibliográfica pertinente ao tema.
Abstract
The theme of this research is the political-criminal strategy proposed by the theory of radical (or critical) criminology, as a response to the current system of social control, which is based on the ideology of social defense (or social control). The research problem focuses on the existing contradiction between the apparent failure of the penal system and its permanence throughout history. The respective hypothesis is based on the fact that the aforementioned system of social control, legitimized by the ideal of social defense, has true political and economic success, in view of its real functions and objectives (hidden). The general objective of this research is to present a political-criminal strategy to the social control system, considering that it is unfair, selective and unequal. Specific objectives of the present work are the approach of the ideology of social defense (or of social control) and of the several criminological theories until the radical criminological theory (or critical) was developed. Radical criminology proposes immediate strategies that culminate in the immediate overcoming of the capitalist political-economic system. For, considering the historical relationship between the penal system of social control and the social structure, it will only be possible to radically rethink the former of that if there is a modification of this one. The approach method used is deductive. As for the methods of procedure, they are embodied in the comparative and in the functionalist. Finally, the research technique used is the literature relevant to the topic.
