dc.description.abstractState jurisdictional immunity constitutes a rule of customary international law, founded upon the principle of the sovereign equality of States. Throughout the development of this rule, however, exceptions have emerged to reconcile State sovereignty with other values protected under international law, among them the territorial tort exception, which allows civil claims for compensation against foreign States for damages or death occurring within the territory of the forum State. This article aims to investigate whether this exception is a rule of customary international law. To this end, it adopts a qualitative approach based on a literature review and documentary analysis, examining domestic legislations, international treaties, UN resolutions, documents of the International Law Commission (ILC) and decisions of domestic and international courts. The identification of customary international law is conducted according to the ILC's methodology established in the Draft Conclusions on Identification of Customary International Law (2018), through the analysis of State Practice and Opinio Juris. The findings are then interpreted in light of Hedley Bull's English School theory, seeking to determine whether the territorial tort exception may be understood as a shared norm among States, even if not yet consolidated as customary international law. The study concludes that, although the evidence reveals a significant expansion of the practice of the territorial exception, there is still insufficient uniformity to characterize it as a customary rule. Nevertheless, its expansion allows it to be understood as a rule of coexistence within International Society, reflecting an emerging norm aimed at protecting victims' right to reparation.pt_BR

dc.description.resumoA imunidade de jurisdição dos Estados constitui um Costume Internacional, fundada no princípio da igualdade soberana entre os Estados. Ao longo do desenvolvimento desse regime, contudo, surgiram exceções destinadas a compatibilizar a soberania estatal com outros valores protegidos pelo direito internacional, dentre elas a territorial tort exception, que permite o ajuizamento de ações civis de reparação contra Estados estrangeiros por danos/mortes ocorridos no território do foro. O presente artigo tem por objetivo investigar se essa exceção pode ser considerada uma norma de direito internacional costumeiro. Para tanto, adota abordagem qualitativa, baseada em revisão bibliográfica e análise documental, examinando legislações nacionais, tratados internacionais, resoluções das Nações Unidas, documentos da Comissão de Direito Internacional (CDI) e decisões de tribunais domésticos e internacionais. A identificação do costume internacional é realizada a partir da metodologia da CDI nas Draft Conclusions on Identification of Customary International Law (2018), mediante a análise de State Practice e Opinio Juris. Em seguida, os resultados são interpretados à luz da teoria da Sociedade Inglesa de Hedley Bull, buscando verificar se a territorial tort exception pode ser compreendida como uma norma compartilhada entre os Estados, ainda que não plenamente consolidada como costume internacional. Conclui-se que, embora as evidências revelem significativa expansão e aceitação da prática da exceção territorial, ainda não há uniformidade suficiente para caracterizá-la como uma regra costumeira universal. Não obstante, sua difusão permite compreendê-la como uma regra de coexistência no âmbito da Sociedade Internacional, refletindo um norma emergente voltada à proteção do direito das vítimas à reparação.pt_BR
