dc.description.abstractBased mainly on the concepts of technical-scientific language and hermetic language, this article aims to trace a relationship between those and the effective jurisdictional provision. In this precept, we go through concepts about access to justice, the substantial contradictory, the procedural dialectic and the mastery exercised by language, and also how these correlate to the problem. In addition, it is also sought to list some proposals for solutions to the problems pointed out, in order to minimize the impacts of these on the jurisdictional provision, mainly based on the theory of legal design. In addition, the methodology used will be the reflection on personal experiences and the reading of authors and bibliographies related to the hypothesis of solution mentioned.pt_BR

dc.description.resumoCom base principalmente nos conceitos de linguagem técnico-científica e linguagem hermética, esse artigo tem por objetivo traçar uma relação entre aqueles e a efetiva prestação jurisdicional. Neste preceito, perpassa-se por conceitos sobre o acesso à justiça, o contraditório substancial, a dialética processual e o domínio exercido pela linguagem, e também como estes se correlacionam ao problema. Além disso, busca-se também elencar algumas propostas de solução para os problemas apontados, de maneira a minimizar os impactos destes na prestação jurisdicional, principalmente com base na teoria do legal design. Ademais, a metodologia utilizada será a reflexão sobre experiências pessoais e a leitura de autores e bibliografias atinentes à hipótese de solução mencionada.pt_BR
