Estudo Comparativo entre as legislações de Saneamento Básico no Brasil: Lei 11.445 de 2007 e Lei 14.026 de 2020.

Abstract

Water is crucial to maintain life as we know it on the Earth, as well to ensure the well-being and advance of our society. In this context, the increase of water needs for full development of human activities, both for domestic and commercial use, contributes to water shortage in urban centers, hindering the maintenance of several essential services, such as basic sanitation, which still a huge challenge in Brazil. In this regard, the present work compares the old and the new Basic Sanitation legislation in Brazil using the comparative methodology, useful for analyzing data with similar general properties, but with specific characteristics. Considerable similarities and differences were detected, which can generate, in medium or long term, both positive and negative effects. Among them, it is worth to mention the concentration of regulation and inspection functions destined to ANA, the establishment of concrete plans and goals, aiming the universalization of sanitation in Brazil through the joint action between public and private initiative. However, we must pay attention to the new contracts and to the new supervisor role that ANA takes on, so that the new plans and goals are satisfactorily achieved. For that, is necessary public and private investments in Basic Sanitation, both in infrastructure and in technical staff, so that public agencies and private companies are able to perform their roles correctly.
