Direito à Assistência Social sob a ótica da mendicância

Abstract

The main objective of this work is to carry out an in-depth study of the constitutional guarantee of social assistance in exchange for one of the most neglected classes in Brazilian cities: begging. In a section, a brief history will be made to the reader about this right and throughout its history to the present day. Shortly thereafter, a brief conceptualization on the mendicant and miserable classes will be presented, supported by doctrinaires, pointing mainly to the discrimination that affects this social layer, with exposure of news and graphics. It should also be mentioned that, in a concise manner, it will be discussed about the present discussion between doctrine and jurisprudence of the criteria used to characterize begging. The present study will be finalized with the exposition about the social and existential minima, making analogy to the concepts presented with the proposed theme.
