Resumo
A presente pesquisa teórico-exploratória propõe-se a investigar se a teoria da Guerra Justa
de Michael Walzer, através das intervenções unilaterais humanitárias, gera como
consequência a ascensão da exceção internacional. Utilizou-se a teoria como marco para
descobrir se, seus justificadores, legitimam a existência de uma exceção internacional
aceitável em certas situações, isso porque sob justificativa da intervenção humanitária ou da
“guerra contra o terror”, Estados promovem intervenções que colocam em xeque a ordem
internacional e a proteção dos Direitos Humanos. Para tanto, buscou-se desvelar a
correlação e a aplicabilidade da Teoria de Walzer dentro do conceito de estado de exceção
a partir da revisão bibliográfica da literatura do autor sobre a Teoria da Guerra justa, de
críticas a ela, e o levantamento de obras que versem sobre a exceção internacional. Assim,
realizou-se um levantamento primário da literatura de Walzer sobre a Teoria da Guerra
Justa bem como sobre a exceção internacional e de literatura secundária apontando críticas
teóricas ao autor. Conclui-se que a teoria de Walzer pode levar a exceção internacional e
ameaça à proteção dos Direitos Humanos e a ordem internacional.
Abstract
This research aims to investigate if Michael Walzer's Just War theory leads to the rise of
the international exception due to its unilateral humanitarian interventions. The theory was
used as a framework to verify if its justifiers legitimize the existence of an acceptable
international exception in certain situations, since under the justification of humanitarian
intervention or the " war against terror," states promote interventions that jeopardize the
international order and the protection of human rights. To do so, we sought to identify the
correlation and applicability of Walzer's Theory within the concept of the state of exception
by reviewing the author's literature on Just War Theory, its critiques, and the collection of
writings on the international exception. We conclude that Walzer's theory can lead to the
international exception and threaten the protection of human rights and the international
order.
