Abstract: Population aging and the increasing presence of older people in armed conflict contexts highlight the need to understand how this group is represented and protected within the humanitarian field. In this context, this study aims to analyze how older people are discursively constructed in reports produced by international humanitarian organizations and how these constructions may contribute to their visibility, protection, or, conversely, to the reproduction of situations of neglect and invisibility. To this end, a qualitative and interpretive research was conducted, drawing on Bakhtinian language studies, the concept of ageism, and International Humanitarian Law. The corpus consists of three reports: No One Is Spared: Abuses Against Older People in Armed Conflict, by Human Rights Watch; Falling Through the Cracks: Older People in Conflict Situations, by Dorcas; and Older Persons in Armed Conflict and Peacebuilding, by Amnesty International. The analysis focused on the discursive forms used to explain why older people do not flee situations of conflict, considering three main dimensions: individual choice, structural obstacles, and physical or psychological limitations. The findings demonstrate that, although the reports recognize concrete vulnerabilities, such as mobility difficulties, illness, lack of resources, inadequate infrastructure, and insufficient social protection, they also employ constructions that associate older people's decision to remain with individual choice, attachment to possessions, and an inability to adapt. Such formulations may shift attention away from structural conditions toward characteristics attributed to old age itself, thereby reproducing stereotypes related to passivity, dependence, and incapacity. It is concluded that the reports not only describe the experiences of older people in armed conflicts but also participate in the construction of meanings concerning this group and its possibilities for agency and protection. Therefore, discourse analysis highlights the importance of considering the ethical and political effects of language in the formulation of humanitarian responses and public policies, contributing to efforts to address ageism and promote protection practices that are more attentive to the complexity of aging.

O Sistema Patriarcal Neoconfucionista e a Representação de gênero nos doramas sul-coreanos

Title: O Sistema Patriarcal Neoconfucionista e a Representação de gênero nos doramas sul-coreanos
Abstract: This study analyzes how South Korean dramas represent and reconfigure gender roles in
dialogue with the neoconfucian patriarchal order, investigating the persistence of this system
of values in South Korea. It is based on the understanding of neoconfucianism as a system of
values that historically structured gender roles in the country and that, despite processes of
modernization, continues to influence social expectations directed at women. The research
adopts a qualitative approach, employing a sequential comparative analysis of selected scenes
from the dramas What’s Wrong with Secretary Kim? (2018) and When Life Gives You Tange-
rines (2025). The analytical focus is organized around three central axes: work, motherhood,
and romantic relationships, allowing observation of how these audiovisual narratives repro-
duce, challenge, or reconfigure patriarchal values grounded in neoconfucianism. The results
indicate that although the dramas feature more autonomous female protagonists and incorporate
discourses associated with gender equality, these productions do not promote a structural rup-
ture with the patriarchal order. Rather, they function as spaces of symbolic negotiation, in which
movements of contestation coexist with mechanisms that maintain gender inequalities. It is
concluded that such representations reflect the tension between continuity and transformation
that characterizes contemporary South Korean society.

A Territorial tort exception e seu uso pelos Estados: entre o costume internacional e as regras de coexistência

Title: A Territorial tort exception e seu uso pelos Estados: entre o costume internacional e as regras de coexistência
Abstract: State jurisdictional immunity constitutes a rule of customary international law, founded upon
the principle of the sovereign equality of States. Throughout the development of this rule,
however, exceptions have emerged to reconcile State sovereignty with other values protected under international law, among them the territorial tort exception, which allows civil claims
for compensation against foreign States for damages or death occurring within the territory of
the forum State. This article aims to investigate whether this exception is a rule of customary
international law. To this end, it adopts a qualitative approach based on a literature review and
documentary analysis, examining domestic legislations, international treaties, UN resolutions,
documents of the International Law Commission (ILC) and decisions of domestic and
international courts. The identification of customary international law is conducted according
to the ILC's methodology established in the Draft Conclusions on Identification of Customary
International Law (2018), through the analysis of State Practice and Opinio Juris. The findings
are then interpreted in light of Hedley Bull's English School theory, seeking to determine
whether the territorial tort exception may be understood as a shared norm among States, even
if not yet consolidated as customary international law. The study concludes that, although the
evidence reveals a significant expansion of the practice of the territorial exception, there is still
insufficient uniformity to characterize it as a customary rule. Nevertheless, its expansion allows
it to be understood as a rule of coexistence within International Society, reflecting an emerging
norm aimed at protecting victims' right to reparation.
